Terms of Service

The terms and conditions governing your use of the FireStart AI Education Platform.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and FireStart ("we," "us," or "our") governing your access to and use of the FireStart AI Education Platform located at firestartagency.com(the "Platform"), including all associated services, features, content, and applications.

By creating an account, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Platform.

2. Eligibility & Account Registration

Age Requirement. You must be at least 13 years of age to create an account on the Platform. If you are under 18, you represent that you have your parent or legal guardian's permission to use the Platform.

Account Accuracy. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

One Account Per Person. Each individual may maintain only one active account. Creating multiple accounts to circumvent restrictions, abuse free-tier benefits, or manipulate the Platform is prohibited and grounds for immediate termination of all associated accounts.

3. Platform Services & Tiers

The Platform offers multiple service tiers, each with distinct features and pricing:

  • Free Tier: Access to the Guides library and 20 lifetime Ember AI Spark credits. No credit card required. No expiration.
  • EmberLearn Subscriptions: Monthly subscription plans (Ember Spark, Glow, and Radiance) that provide additional monthly Spark credits for the Ember AI assistant. Subscriptions auto-renew monthly. Credits reset on each billing cycle and do not roll over.
  • FireStart Applied AI Program: A cohort-based, instructor-led training program offered in specific enrollment windows. The program includes live sessions, coaching, recordings, and resources. Cohort availability, pricing, and curriculum are subject to change between cohorts.

We reserve the right to modify, suspend, or discontinue any service tier, feature, or pricing at any time with reasonable notice to affected users.

4. Payments & Billing

EmberLearn Subscriptions. EmberLearn subscriptions are billed monthly through PayPal. By subscribing, you authorize recurring monthly charges to your PayPal account. You may cancel your subscription at any time through your portal settings or by contacting us. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for the remaining days of a billing cycle.

FireStart Program Enrollment. Cohort enrollment fees are one-time payments processed through PayPal at the time of enrollment. Refund eligibility for program fees is determined on a case-by-case basis and must be requested within 7 days of enrollment. Once a cohort has commenced, refunds are generally not available.

Coaching Tickets. Coaching tickets may be purchased, sold, or transferred through the Platform's coaching ticket marketplace. All marketplace transactions are processed through PayPal. Tickets are non-refundable once a coaching session has been delivered.

Spark Credits. Sparks are the Platform's credit unit for AI assistant interactions. Free-tier Sparks are granted once (lifetime allocation). EmberLearn Sparks reset monthly on your billing date. Unused Sparks do not roll over between billing cycles and have no monetary value. Sparks cannot be transferred, sold, or exchanged for cash.

Taxes. All prices are listed exclusive of applicable taxes. You are responsible for any taxes, duties, or levies applicable to your purchases.

5. Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Platform for any illegal, fraudulent, or unauthorized purpose.
  • Attempt to gain unauthorized access to any part of the Platform, other users' accounts, or any systems or networks connected to the Platform.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Platform or any AI models used within it.
  • Scrape, crawl, or use automated tools to extract data or content from the Platform without our express written consent.
  • Upload, transmit, or distribute any content that is unlawful, defamatory, abusive, harassing, threatening, hateful, or otherwise objectionable.
  • Use the Ember AI assistant or any AI-powered feature to generate content that violates any law, infringes on third-party rights, or is intended to deceive, manipulate, or harm others.
  • Share, resell, or redistribute premium content (recordings, resources, curriculum materials) outside the Platform without written authorization.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the Platform or servers, or violate the security of any network.

6. Intellectual Property

FireStart Content. All content on the Platform — including but not limited to curriculum materials, recordings, resources, guides, templates, UI design, branding, logos, and text — is the property of FireStart or its content licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from Platform content without our prior written consent.

Guide Creator Content. Some Guides feature content from third-party creators. Such content remains the intellectual property of the respective creators and is made available on the Platform under license. You may interact with this content through the Platform but may not download, redistribute, or repurpose it.

User-Generated Content. You retain ownership of content you create and submit through the Platform (e.g., chat messages, profile information, coaching session notes). By submitting content, you grant FireStart a non-exclusive, royalty-free, worldwide license to use, display, and store that content solely for the purpose of operating and improving the Platform.

AI-Generated Content. Responses generated by the Ember AI assistant or other AI features are provided for informational and educational purposes only. AI-generated outputs may not be accurate, complete, or suitable for any particular purpose. You use AI-generated content at your own risk and discretion.

7. AI Features Disclaimer

The Platform integrates AI-powered features (including the Ember AI assistant and Guide Agent Chat) powered by the Google Gemini API. You acknowledge and agree that:

  • AI-generated responses are probabilistic and may contain inaccuracies, errors, or outdated information.
  • AI features are provided "as-is" without warranties regarding accuracy, reliability, or fitness for a particular purpose.
  • You should not rely on AI outputs as professional, legal, financial, or medical advice.
  • Your interactions with AI features may be processed by third-party AI services (Google Gemini API) subject to their own terms and data practices.
  • AI feature availability, quality, and capabilities may change at any time as models and technology evolve.

8. Coaching & Marketplace

Coaching Services. The FireStart Program and coaching ticket marketplace provide access to coaching sessions with FireStart coaches. Coaching is educational in nature and does not constitute professional consulting, legal, financial, or business advice. Coaches make no guarantees regarding specific outcomes or results.

Marketplace Conduct. If you list coaching tickets on the marketplace, you agree to fulfill the services described in your listing honestly and in good faith. FireStart reserves the right to remove listings, suspend marketplace privileges, or take other action against users who violate these Terms or engage in deceptive marketplace practices.

Disputes. In the event of a dispute between a buyer and seller on the marketplace, FireStart may, at its sole discretion, mediate the dispute, issue refunds, or take other appropriate action. FireStart's decision in such matters is final.

9. Termination & Suspension

By You. You may close your account at any time by contacting us at staff@firestartagency.com. If you have an active EmberLearn subscription, you are responsible for canceling it before closing your account to avoid further charges.

By Us. We reserve the right to suspend or terminate your account, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive behavior, or if required by law. Upon termination, your right to access the Platform ceases immediately. We are not liable for any loss of data or content resulting from account termination.

Effect of Termination. Upon termination, all licenses granted to you under these Terms immediately expire. Sections that by their nature should survive termination (including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law) will survive.

10. Disclaimer of Warranties

THE PLATFORM AND ALL SERVICES, CONTENT, AND FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any content, including AI-generated content, educational materials, or user-submitted information.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIRESTART AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO FIRESTART IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless FireStart and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit or transmit through the Platform.

13. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising out of or relating to these Terms or the Platform shall be resolved through good-faith negotiation between the parties. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You agree that any claims or causes of action arising out of or related to these Terms or the Platform must be filed within one (1) year after the cause of action arose, or be permanently barred.

14. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and may notify you through the Platform or via email. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms.
